 This Privacy Notice (“Notice”) describes what Personal Data (as defined below) Enlight Renewable Energy Ltd. and its affiliated companies (collectively “Enlight”, “we”, “our” or “us”) collects and processes on our job candidates and applicants (“candidate”, “you” or “your”) during our application and recruitment process and thereafter. This Notice will further describe the purposes for which the Personal Data is collected, how we use it, and how you may exercise your data protection rights. This Notice applies to candidates in the territories where we offer job opportunities and is therefore subject to the General Data Protection Regulation (“GDPR”).

This Notice is in addition to our Privacy Policy governing the use of our website at: https://enlightenergy.co.il/. We encourage you to thoroughly review this Notice along with any other notices we provide. If you do not agree with any part of this Notice, we ask that you refrain from submitting your Personal Data to us.

 

  1. DATA CONTROLLER AND CONTACT INFORMATION

Enlight acts as the “data controller” of the Personal Data collected from candidates. Such a role entails our responsibility for determining how your Personal Data is processed, stored, and used. We also implement the necessary measures to secure your Personal Data and ensure you can exercise your rights where applicable.

  1. PERSONAL DATA WE COLLECT AND PROCESS

As part of our recruitment process and your application, we collect Personal Data about you. The term ”Personal Data” shall include the following:

  • Identifying Information. Name, date of birth, government-issued identification number, copy of identification certificates (e.g., ID, passport, SSN, etc.);
  • Contact Information. Email address, phone number, and physical address;
  • Education and Qualifications. Degrees, certificates obtained, relevant courses, etc.;
  • Employment History. Curriculum Vitae (resumé) information, including previous job titles, skills, work experience, former employers, education, etc.;
  • Legal Work Status. The legal work status in the relevant territory, e., citizenship state, visa permits, application status, etc.;
  • Social Network Profiles. Information published in your Facebook or LinkedIn profile, other social networks, and relevant websites;
  • Personal Evaluations. Information note submitted with the application, information from interviews, tests, internal discussions within Enlight about you, and any other assessments;
  • Internal Correspondence and Records. All records and internal correspondence between us during the recruitment process (e.g., emails, call records, notes);
  • Background Check (where applicable). Subject to the applicable laws, information from references and background checks;
  • Any Additional Information Provided. Any additional information you choose to provide us voluntarily such as a cover letter, salary expectations, etc.

Personal Data may further include types of information defined under the GDPR and any applicable data protection laws such as “Sensitive Data” which may include information such as:

  • Financial Information;
  • Health Related Information, etc.

We will collect, store, and use various types and categories of Personal Data about candidates, which may further include Sensitive Data.

 

  1. THE PURPOSE OF COLLECTION AND HOW PERSONAL DATA IS USED

We use your Personal Data for the following purposes:

  • Evaluating Job Applications and Hiring Decisions. We assess your suitability for the position, qualifications, and skills. We further establish our decision-making process by comparing candidates and choosing the best fit for us. Occasionally, and in accordance with applicable laws, we may also consider you for other open job positions within Enlight.
  • Legal Compliance. We ensure adherence to the applicable and relevant laws and regulations (g., labor laws).
  • Verification and Checks. We verify the accuracy of the information you provide, such as your education, professional references, and employment history.
  • Communication and Contact. We conduct communications and correspondence with you throughout the recruitment process, g., scheduling interviews and meetings, addressing inquiries, and updating you on the position status.
  • Human Resource Administration Duties. We perform human resources-related obligations and legal duties.
  • Records-Keeping. We maintain records of the recruitment process, e., evaluations, assessments, protocols, interviews, and decision-making documents. Further, we obtain such records for legal and regulatory requirements, such as reporting responsibilities, and for any future potential claims or disputes that may arise.
  • Process Improvement. For our internal use for the purpose of analyzing and improving Enlight’s recruitment practices and processes.

 

We use your Sensitive Data for the following purposes:

  • Records-Keeping. We maintain records of the recruitment process, e., evaluations, assessments, protocols, interviews, and decision-making documents. Further, we obtain such records for legal and regulatory requirements, such as reporting responsibilities, and for any future potential claims or disputes that may arise.
  • Monitoring Diversity and Equal Opportunity. When applicable, we may request such information for the purpose of monitoring the diversity status in our company, and to ensure we are providing equal opportunity as appropriate.
  • Human Resource Administration Duties. We perform human resources-related obligations and legal duties.

 

  1. LAWFUL BASIS FOR COLLECTING THE PERSONAL DATA
  • Legitimate Interest. The main lawful basis we rely upon for the collection of Personal Data is Enlight’s legitimate interest in deciding with respect to the candidates’ applications and completing the recruitment process. We may further retain certain types of Personal Data, subject to our legitimate interest, even after the decision-making process, when we believe it is necessary for complying with applicable laws, for internal records-keeping, evaluating and improving our recruitment process, and for addressing and handling against future potential disputes or legal
  • Contract. The lawful basis for handling the later stages of the recruitment process, such as negotiations and while advancing towards entering a contractual relationship, is contractual obligations according to Article 6.1. (b) to the GDPR.
  • Consent. Where required under the GDPR and other applicable data protection laws, we will obtain your consent to retain and further use Personal Data for future job opportunities we may offer you. Note, you have the right to withdraw your consent at any If we process Sensitive Data to ensure diversity, we will do so upon your explicit consent, which you may withdraw at any time by contacting us.

 

  1. HOW DO WE COLLECT PERSONAL DATA

We may collect Personal Data directly from you, as you provide it voluntarily through your application and candidacy review process, or from other sources such as recruitment agencies, or your references, etc.

 

  1. WITH WHOM WE SHARE YOUR PERSONAL DATA
  • Enlight Company’s Group. Personal data may be shared with, or transferred to, our affiliated corporate group entities, and subsidiaries to enable Enlight to manage the recruitment process as relevant, e., facilitating, managing, and operating the recruitment process and administration and performance of human resources-related duties, obligations, and procedures.
  • Vendors, Service Providers and Contractors. Personal Data may be shared with, or transferred to, our trusted agents and service providers (g., recruitment agencies, recruitment management SaaS providers, cloud and hosting providers, legal counsels, etc.). Personal Data is shared with such third parties so that they can perform the requested services on our behalf and subject to our instructions, such as Comeet.   • Governmental Agencies, or Legal Authorized Third Parties. Personal Data may be shared with, or transferred to, subject to law enforcement request or a competent authority request, g., requests relating to criminal investigations or alleged illegal activity, court order, subpoena, or any activity that may expose us, you, or any other third party to legal liability, and solely to the extent necessary.
  • Acquisition and Merge. In the event that we are acquired by, or merged with, a third party entity, or in the event of bankruptcy or a comparable event, we reserve the right to transfer, disclose or assign your Personal Data in connection with the foregoing events, including, in connection with, or during negotiations of, any merger, sale of company assets, consolidation or restructuring, financing, or acquisition of all or a portion of our business by or to another company.
  1. DATA RETENTION AND SECURITY PRACTICES
  • Retention. We will retain your personal data for as long as necessary to fulfill the purposes we collected it for, including to assess you as a candidate. Under certain circumstances, we may retain your Personal Data even after the applied position has been filled or closed, when permitted by applicable regulations, and for example:
    • where we are required to do so in accordance with legal, regulatory, tax, or accounting requirements;
    • for us to have an accurate record of your dealings with us in the event of any complaints or challenges; or
    • if we reasonably believe there is a prospect of litigation relating to your Personal data.
  • Every 6 months, each candidate in the system receives an e-mail asking permission to keep their Personal Data for an extended period of time. If the candidate does not answer – by default, your Personal Data will deleted. If for any reason, the employment is not established, by default we will delete your data in up to six months, unless you will give us your consent, and in that case, the Personal Data will be stored for up to three years.
  • Security. We implement industry-standard measures to reduce the risks of damage, loss, unauthorized access, or use, of your Personal Data. However, these measures do not provide absolute information security.   1. INTERNATIONAL DATA TRANSFERS

We as a controller, host and store your Personal Data in connection with our use in our data servers which are in the European Economic Area (EEA) and in the State of Israel. Our HQ is based in Israel, which is a country that provides an adequate level of data protection. In any case, we need to transfer your Personal Data outside of your jurisdiction, we will take appropriate measures to ensure that your Personal Data receives an adequate level of protection as required under applicable law. Furthermore, when we transfer your Personal Data to a country that has not received an adequacy decision from the European Commission or the ICO, we will take necessary steps to ensure that sufficient safeguards are provided during the transfer and in accordance with the provision of the Standard Contractual Clauses.

  1. DATA SUBJECTS RIGHTS

As mentioned, we value the privacy of each individual and are committed to protecting our candidates’ rights in relation to their Personal Data. Therefore, you will be granted the following rights, all subject to your jurisdiction:

  • Right to know what Personal Data we collect about you, the purpose of collection and use, with whom we share your Personal Data;
  • Right to access and inspect Personal Data, which entitles you to review or receive a copy of certain Personal Data we hold about you;
  • Right to correct inaccuracies, also known as “rectification”, which entitles you to have incomplete or inaccurate Personal Data corrected;
  • Right to request deletion of your Personal Data, where you can request to delete certain Personal Data (subject to limitations and our rights under applicable data protection laws);
  • Right to request to restrict processing of Personal Data, where you can request to limit the purposes for which we process your Personal Data (subject to conditions, limitations, and our rights under applicable data protection laws);
  • Right to object to the processing of your Personal Data, where you can object to our processing of your Personal Data if one of the conditions set forth under applicable data protection laws are met;
  • Right to data portability, where you can request the transfer of your Personal Data to another third party subject to meeting certain conditions;
  • Right to withdraw consent, where we have collected, or we process Personal Data based on your consent;
  • Right to not to be subject to a decision based solely on automated processing; and
  • Right to appeal or lodge a complaint with supervisory authority. In the event we decline to take action on your request, we will inform you as required under applicable data protection laws, and you may appeal to us or an applicable For EEA/UK Candidates*, you have the right to lodge a complaint with the applicable Data Protection Authority in the EU or the Information Commissioner in the UK.

  1. MINORS

We do not intend to collect Personal Data of minors or children. The phrase “child” shall be defined by the applicable territorial legislation and regulations.
